Bakalářská práce předkládá ucelený přehled alternativních trestu de lege lata. Teoretická část práce pojednává v obecné rovině o účelu a pojmu trestu. Zaměřuje se podrobně na právní úpravu trestu domácího vězení v ČR a nabízí základní srovnání s právní úpravou TDV ve vybraných zemích EU. Dále se zabývá postavením a úkoly PMS v rámci dohledu výkonu TDV.V praktické části jsou podrobně popsány dva konkrétní případy trestu domácího vězení s rozdílným závěrem. V závěru práce je hodnocena efektivita trestu domácího vězení v penitenciární praxi. |

The bachelor's degree thesis presents the integral compendium of alternative punishment types 'de lege lata'. Its theoretic part deals with the purpose and object of punishment from a general point of view. It aims, in detail, on the arrangements of house arrest in the Czech Republic, and it offers a basic comparison with the legislative adaptation of this punishment type in some EU countries. The thesis also deals with the status and function of the probationary and mediatory services, as concerns the supervision of the house-arrest punishment.In the practical part, two factual cases of house-arrest punishment have been described, showing different conclusions. In the end of the thesis, the effictiveness of the house-arrest punishment in the penal practice has been evaluated. |
