Tato bakalářská práce pojednává o alternativních trestech v České republice a uvádí jejich okomentovaný seznam. Rovněž se v práci pojednává o tom, co je z hlediska českého trestního práva možno považovat za trestný čin, co je restorativní a retributivní justicí a jejich výhody či nevýhody a celosvětové problémy v této oblasti. V této práci je rovněž věnována podstatná část restorativní justici jako takové a snaha o určení její definice a cíle, což je základním předpokladem pochopení tohoto směru justice. Nedílnou součástí je rovněž pojetí restorativní justice ze sociálně pedagogického hlediska, negativní a pozitivní důsledky trestu a uplatňování trestů v případě mladistvých pachatelů. |

This bachelor thesis deals with an alternative penalty in the Czech republic and presents their commented list. It also indicates options for using the therms like criminal offense, restorative and retributive justice with thein advantages, disadvantages and all global problems in this part in criminal law of the Czech republic. Substantial part of this work i salso devoted to restorative justice, as such, and to the determinativ of its defenition and ibjectives, which is a basic prerequisite for understanding the direction of justice. An internal part of this work is the koncept of restorative justice in socio-educational point of view, positive and negative consequences of punishment and the application of penalties in the case of juvenilie offenders. |
