Diplomová práce se zabývá specifickou skupinou nezletilých bez doprovodu na území České republiky. První kapitola teoretické části diplomové práce je zaměřena na právní postavení dítěte v migrační situaci, dále na právní postavení nezletilých bez doprovodu v kontextu mezinárodně-právních předpisů, zejména Úmluvy o právech dítěte, práva Evropské unie a právního řádu České republiky. Druhá kapitola teoretické části diplomové práce pojednává o univerzálním právu dítěte na vzdělání, dále o právu na základní, středoškolské, vysokoškolské vzdělání a o právu na informace. Kapitola rovněž přibližuje možnosti vzdělání nezletilých bez doprovodu v českém školském systému. Praktická část se zabývá jako předmětem zkoumání Zařízením pro děti-cizince, jež formou případové studie charakterizuje tuto specifickou školskou instituci vykonávající svoji činnost v síti zařízení pro výkon ústavní a ochranné výchovy, s územní působností pro Českou republiku. Zařízení pro děti-cizince poskytuje nezletilým bez doprovodu plné zaopatření včetně vzdělávání, výchovy, a dalšího rozvoje za účelem budoucí úspěšné integrace do běžného života v české společnosti. |

This graduation theses focuses on the issue of a specific kind of unaccompanied minors or separated children in the territory of the Czech Republic. The first chapter in the theoretical part of my work aimes towards legal status of a child in the migration and towards legal status of unaccompanied minors in the context of International Law, especially the Convention on the Rights of the Child, European Union Law and the Law of the Czech Republic. The second chapter of the graduation theses in the theoretical part deals with child´s general right to education and then the right to primary, secondary, university education and the right to information. The chapter also introduces possibilities for education of unaccompanied minors or separated children in the Czech school system. In the third part of my work the subject of examination becomes the Facility For Children - Foreigners, which in the form of a case study characterizes this specific educational institution that operates under the network of facilities for institutional and protective education, with territorial activity in the whole territory of the Czech Republic. The Facility For Children - Foreigners provides full procurement to the unaccompanied minors or separated children, including scholarship, education and desirable development for the purpose of future successfull integration of unaccompanied minors into the usual life of Czech society. |
