Předmětem bakalářské práce ?Alternativní tresty versus trest odnětí svobody - střet sociálních, výchovných a formálních hledisek? je deskripce právních, sociálních, výchovných a dalších aspektů alternativních sankcí z teoretického i praktického hlediska. Jejím cílem pak je nejen poskytnutí celkového přehledu o předmětné oblasti, ale i zodpovězení otázky možného využití potenciálu sociální pedagogiky a jejích metod v rámci výkonu jednotlivých alternativních trestů za účelem důkladnějšího preventivního působení na odsouzeného i společnost a zvýšení efektivnosti jejich výkonu. Celkově je vedena záměrem nalezení východiska vedoucího k možnému zmírnění či odstranění rozporů, k nimž dochází mezi sociálními, výchovnými a formálními jejich hledisky. Práce obsahuje pojednání o jednotlivých alternativních sankcích jak u dospělých, tak u mladistvých pachatelů. Zvláštní pozornost je zde věnována trestu obecně prospěšných prací. Nechybí ani nástin možného využití sociální pedagogiky a jejích metod při působení na pachatele v rámci těchto trestů. |

The subject of the Bachelor Thesis ?Alternative punishment versus prison sentence - conflict of the social, educational and formal aspects? is the description of the legal, social, educational and other aspects of the alternative sanctions from the theoretical and also practical standpoints. The goal of this Bachelor Thesis then is not only provision of the total survey about the subject area, but also answer to the question of the possible utilization of the social pedagogy potential and of their methods in the frame of the separate alternative punishments execution with the purpose of the more radical preventive incidence to the convict and also to the society and increasing of the effectiveness of their executions. Total it is led with the intention to find way out leading to the possible modulation or elimination of the discrepancies, which occur between their social, educational and formal aspects. The Thesis contains essays about the separate alternative sanctions as at the adult persons, so at the teenage offenders. Either the outline of the possible utilization of the social pedagogy and of its methods doesn't miss at the incidence to the offender in the frame of these punishments. |
