Cílem mé bakalářské práce s názvem " vyšetřování pojistných podvodů " je poskytnout ucelenější pohled na problematiku pojistných podvodů, informovat o právních předpisech, souvisejících s pojistnými podvody a pojišťovnictvím vůbec a o důvodech zavedení skutkové podstaty trestného činu pojistný podvod do zákona č.140/1961 Sb., trestní zákon. V práci se dále hovoří o rozdílu mezi trestným činem podvodu a trestným činem pojistného podvodu, o hlavních formách a kriminogenních faktorech umožňujících páchání dané trestné činnosti, dále o úkolech Policie České republiky při odhalování a vyšetřování této trestné činnosti, včetně zvláštností s tím souvisejících, o postupu při získávání důkazních prostředků v souvislosti s trestním řízením, o statistickém porovnání odhalených a objasněných pojistných podvodů z pohledu Policie České republiky, Kooperativa pojišťovny, a.s., Vienna Insurance Group a některých dalších pojišťoven a v neposlední řadě o některých konkrétních odhalených případech pojistných podvodů v dopravě. |

The bachelor thesis tries to give an integrated view of insurable fraud problems, to inform about legal rules associated with insurable frauds and insurance system and inform about reasons which led to the implementation of the insurable fraud crime to the 140/1961 law (the penal code). The thesis describes the differences between the fraud crime and the insurable fraud crime, the main forms of the insurable fraud crime and the criminological factors which enable to commit these crimes. The thesis talks about police Czech Republic tasks during the detection and inquiry of these crimes, about procedures of obtaining proves, about a statistical comparison of detected cases and cleared up cases from the point of view of the police Czech Republic, from Kooperativa insurance company view, several other insurance companies views and about several particular insurable frauds in transportation. |
